Michael Jackson's Family Loses Wrongful Death Lawsuit

Concert promoter AEG Live was not negligent in the death of Michael Jackson and the singer's mother and children shouldn't receive any money in damages, a jury found Wednesday.

After four days of deliberations, the Los Angeles Superior Court panel found that Dr. Conrad Murray, who gave the pop star a deadly dose of a powerful anesthetic, was not unfit or incompetent to perform the work for which he was hired.

"The jury's decision completely vindicates AEG Live, confirming what we have known from the start – that although Michael Jackson's death was a terrible tragedy, it was not a tragedy of AEG Live's making," says AEG attorney Marvin Putnam.

 

 

During the civil trial, which started in April, attorneys argued over whether Jackson's death on June 25, 2009, was his doctor's fault or his own, and whether Murray was Jackson's employee or the concert promoter's. The jury began deliberating on Sept. 26.

Murray was not party to the proceedings. The doctor, who claims to be destitute, was convicted of manslaughter in Jackson's death in November 2011 and is scheduled to be released from jail on Oct. 28. {C}

A criminal trial jury two years ago found that Murray caused Jackson's death by carelessly administering large doses of the milky anesthetic propofol in the singer's bedroom.

Among the 58 witnesses who testified during the five-month AEG civil trial was lead plaintiff Katherine Jackson, who said her son "loved everybody" and "the most difficult thing is to sit in this court and listen to all the bad things they're saying about my son. A lot of those things are just not the truth."

 

Playing Russian Roulette

Attorneys for AEG agreed that Jackson's death at age 50 was a tragedy, but not one that the company caused. Witnesses testified that Jackson shopped for a doctor who would secretly give him propofol behind closed doors to help him sleep.

 

AEG would not have financed Jackson's This Is It tour "if it knew Mr. Jackson was playing Russian roulette in his bedroom every night," AEG lawyer Marvin Putnam said during three days of closing arguments. "The sad truth is Mr. Jackson's death was caused by his choices and it would have happened no matter what – with or without AEG Live."

Jackson attorneys claimed AEG put Murray on its payroll to push Jackson through a 50-concert comeback tour despite indications that he was in frail health.

 

Risk vs. Profit

After Jackson missed a few rehearsals and Murray expressed concern about Jackson's health, AEG CEO Paul Gongaware sent an email allegedly stating, "You remind Murray who's paying his bill," according to trial testimony.

AEG Live "chose to run the risk and make a huge profit," argued Jackson family attorney Brian Panish, who suggested Jackson was 20 percent to blame. "It's about shared responsibility."

Agencies fight over [Victoria’s Secret] stunner

Victoria's Secret model Daiane Sodre da Silva surreptitiously switched modeling agencies, says Marilyn Modeling Agency, which is suing her for being a two time

The secret's out. A Victoria's Secret model surreptitiously switched modeling agencies, and now her former one is suing her for being a two timer.

In papers filed in Manhattan Supreme Court, Marilyn Modeling Agency says it brought Brazilian bombshell Daiane Sodre da Silva to the U.S. with a three-year exclusive deal in August 2011. The agency says it landed her some high-profile gigs, including jobs with Victoria's Secret, Oscar De La Renta and J. Crew - but she still snuck behind their back to sign a deal with rival agency Major this past June.

Adding insult to injury, the Sao Paulo stunner stiffed them on $17,000 in commissions, and Major has been using Marilyn's pictures to promote Sodre on its website. The suit accuses Major of having "induced or otherwise arranged with Sodre to breach her contract," and Sodre of "unjustly enriching" herself. It seeks a court order voiding the Major deal, and money damages from both Sodre and Major.

Major vice-president Elizabeth Gubitosi said Sodre came to them "because she wasn't making any money at Marilyn," and had been looking for new representation. She said they'd defend the allegations of wrongdoing in court.

"She's an amazing person," Maksim gushed to Us. "We have an incredible time together, and, you know, I definitely didn’t see that coming and I think neither did she. We enjoy each other's company very much and like I said, she's a great girl that I never thought anything romantic like this could have happened."

Petition calls for brands to end work with 'pornographic' Terry Richardson

An online petition is urging big name brands to end their their use Miley Cyrus' photographer Terry Richardson from future campaigns due to claims of innapropriate behaviour towards his female subjects. Richardson who directed Miley Cyrus' 'Wrecking ball' video and the overtly-raunchy photo shoot afterwards is the subject of a petition that highlights the negative impact he is having on society. Richardson is no stranger to controversy following a history of drug abuse, schizophrenia and multiple allegations regarding sexual misconduct on fashion sets. You can view the petition here. Richardson has also worked with Lady Gaga, Beyonce, Sky Ferreira and appears in the 30 Seconds To Mars video 'Hurricane'.

The petition reads: 'More awareness needs to be brought to light that Terry Richardson is negatively influencing media with his supposed exploit & abuse of certain models, mainstream degrading pornographic imagery, and inappropriate and unproffessional behavior.' Going on to state: 'His contribution to society has a bad impact as he is being exposed to the masses with the impression of being well received while there are potentially unethical practices not being shown. Allegations and complaints have been publicised from the likes of Coco Rocha, Jamie Peck and Danish Supermodel Rie Rasmussen'.

The page also contains quotes from Jamie Peck and a fashion insider who says agencies 'know full well Richardson's predatory behavior,' but that he 'is tolerated because the industry folk are just sheep. There are only a handful of photographers who have the power, a handful of editors who have the power, and a handful of clients who have the power. Everyone else just follows this small group of people'.

Another Angel Might Be Out At Victoria's Secret

Another Victoria's Secret model might not walk in the company's famous fashion show next month. Erin Heatherton might be ousted for being "difficult to work with," reports Stephanie Smith at The New York Post. Heatherton famously met her now-ex-boyfriend Leonardo DiCaprio at the show two years ago.

Miranda Kerr was reportedly ousted from the brand under similar circumstances earlier this year. Kerr, the wife of actor Orlando Bloom, had a "difficult" reputation and wasn't a big seller like Alessandra Ambrosio and Candice Swanepoel, according to a report by Joyce Chen at UsWeekly. Reps from Kerr and the brand denied that the split was acrimonious. Still, Kerr is noticeably absent from the fashion show line-up this year.

The company hasn't commented on final details for the show, which tapes November 13.
