Harvey Weinstein's private flight to an Arizona rehab facility was diverted at the last minute, and he touched down in a different city than originally planned ... TMZ has learned.

 

Weinstein is now getting treatment somewhere in the Scottsdale area ... according to well-connected sources. As we reported, the private jet that took off from L.A. Wednesday evening was scheduled to touch down in Wickenburg, AZ ... near The Meadows rehab center.

 

We're told there had been continued debate in Weinstein's camp about where he should go. You'll recall, there was also talk of him going to Europe -- but ultimately a last-minute decision was made to touch down in Scottsdale.

Harvey Weinstein may have been fired illegally by The Weinstein Company, a company that wrote a contract that said Weinstein could get sued over and over for sexual harassment and as long as he shelled out money, that was good enough for the Company.

 

TMZ is privy to Weinstein's 2015 employment contract, which says if he gets sued for sexual harassment or any other "misconduct" that results in a settlement or judgment against TWC, all Weinstein has to do is pay what the company's out, along with a fine, and he's in the clear.

 

According to the contract, if Weinstein "treated someone improperly in violation of the company's Code of Conduct," he must reimburse TWC for settlements or judgments. Additionally, "You [Weinstein] will pay the company liquidated damages of $250,000 for the first such instance, $500,000 for the second such instance, $750,000 for the third such instance, and $1,000,000 for each additional instance."

 

The contract says as long as Weinstein pays, it constitutes a "cure" for the misconduct and no further action can be taken. Translation -- Weinstein could be sued over and over and as long as he wrote a check, he keeps his job.

 

The contract has specific language as to when the Board of Directors can fire Weinstein -- if he's indicted or convicted of a crime, but that doesn't apply here.

 

There's another provision ... he can be fired for "the perpetuation by you [Weinstein] of a material fraud against the company." The question ... where's the fraud? Lance Maerov, the board member who negotiated Weinstein's 2015 contract, said in an interview -- and we've confirmed -- the Board knew Weinstein had settled prior lawsuits brought by various women, but they "assumed" it was to cover up consensual affairs. The Board's assumption does not constitute fraud on Weinstein's part. 

 

And here's the kicker. Even if Weinstein had committed fraud by not fully informing the Board of Directors, the contract says before he can be fired he has a right to mediation and if that doesn't work, he's entitled to arbitration. He got neither. He was summarily fired, and sources connected with Weinstein tell TMZ he was never given a specific reason.

 

A source connected with TWC tells TMZ, the company had a right to fire Weinstein if he didn't notify the Board of Directors of settlements. We're told there have been no settlements since the contract was signed, so it would seem this clause does not apply.

Harvey Weinstein is taking a 5-star time-out before he enters rehab.

 

The disgraced movie mogul checked into the Phoenician Resort Wednesday night in Scottsdale, Arizona, and will remain there until he begins treatment. We're told he could be at the resort until some time Friday -- at which point he'll be driven to a rehab facility.

 

TMZ broke the story ... there's been heavy debate within Weinstein's camp as to where he should go. Initially, he was going to Europe, but by the time his private jet took off from L.A. ... the choice was The Meadows in Wickenburg, AZ.

 

We're now told it will be a different facility, somewhere near Scottsdale.

Yep, Alicia Vikander and Jennifer Lawrence are the top guesses. Someone pointed out that Alicia got a deal with Louis Vuitton and Vogue covers. Weinstein is good friends with Bernard Arnault (CEO of LVMH) and Anna Wintour. And that she was added on Burnt, which was released by TWC, even though her part wasn’t in the original script.

Harvey Weinstein had what looked like just another night out with friends Thursday ... which could not be further from the truth.

 

Weinstein had dinner at Uncle Sal's restaurant in Scottsdale, AZ ... what we're told will be his last supper before checking into a nearby rehab facility. The restaurant is 15 minutes from the Phoenician Resort, where he checked in Wednesday night after flying from L.A.

 

The fallen mogul broke bread with 3 guys and a woman, and eyewitnesses say you would never know Weinstein was in the eye of a ferocious storm. One witness said, "He was acting normal, fine, like he didn't have a care."

 

He clearly has a care. As we reported, his daughter called 911 Wednesday, saying her dad was suicidal and upset, although when cops arrived she took it back and said they were just having an argument.

As Weinstein goes for help in the land of McCain, his lawyers are hammering The Weinstein Company. TMZ broke the story ... TWC may have violated his contract by firing him. The contract shockingly allowed Weinstein to stay on with the company -- regardless of how many sexual harassment claims were lodged -- as long as he paid the settlement costs and a penalty to the company.

He is already talking about getting a second chance.

 

Of course he is 100% going to be rehabilitated eventually.

 

Hollywood is sick to the core, but this is nothing new. Look up Patricia Douglas, Loretta Young, Natalie Wood, ... and countless other women's stories.

 

Men like Harvey Weinstein have thrived in Hollywood because their behavior is the norm, not the exception there.

That would be interesting, but nothing surprises me anymore. The moral are immoral and the immoral are moral, and both are neither. (I think that made more sense in my head than in text form)

Channing Tatum pulls Weinstein Company sexual abuse film



Channing Tatum has halted the development of a film about sexual abuse, which he had been making with Harvey Weinstein's company.
Mr Weinstein "unequivocally denies" allegations of sexual assault, harassment and rape.
The Oscar-winning producer was fired as chairman of The Weinstein Company last week, when the allegations emerged.
"The brave women who had the courage to speak their truth about [Mr] Weinstein are true heroes to us," said Tatum.
"They are lifting the heavy bricks to build the equitable world we all deserve to live in.

Reid Carolin produced Logan Lucky, which starred Channing Tatum
"Our lone project in development with The Weinstein Company (TWC) - Matthew Quick's brilliant book, Forgive Me Leonard Peacock - is a story about a boy whose life was torn asunder by sexual abuse.

The project would have seen Tatum starring in the film and also directing for the first time, alongside Reid Carolin.

After a certain amount of time had elapsed, you'd probably have to say that it wouldn't be too hard for Richardson to present himself as a reformed character and try to get hired again. The question would then be, if he genuinely stopped abusing his position, would he be accepted as a working photographer again, or has enough happened in the past to ensure that he should stay gone.
